The Marasco & Nesselbush Personal Injury team recently obtained a six-figure settlement in a personal injury case that involved a Rhode Island pedestrian who was struck by a motor vehicle. Our client was wearing a high visibility vest and using a flashlight to stop traffic while assisting another vehicle who was trying to enter the lane of travel. Despite our client’s precautionary measures, he was hit by a car traveling at a high speed.
When the car struck him, he was lifted onto the hood of the car, then into the windshield and ultimately landed on the pavement. The injuries suffered were severe, including complex fractures to his left leg requiring several open reduction and internal fixation surgeries resulting in significant medical bills and many months of physical therapy. He was ultimately left with a permanent impairment to his lower extremity.
The Personal Injury team of Attorney Thomas Moran and Legal Assistant Lisa Hanlon built a strong case but were tested when the insurance carrier attempted to diminish our client’s substantial damages. The insurance company argued that some of the hundreds of medical treatment records were a result of a subsequent fall that occurred between our client’s surgeries. Attorney Moran and the team were successful in overcoming the insurance company’s argument by showing that our client’s fall was a result of the imbalance the client experienced while recovering from his initial surgery.
The Marasco & Nesselbush team never ceased to give up, even filing a lawsuit in Superior Court against the negligent driver. After 26 months of pushing and battling with the insurance company, M&N was able to ultimately recover $330,000 as compensation for the client’s medical bills, loss of earning capacity, permanent scarring and impairment, and pain and suffering. This substantial recovery for our client changed his life. While we hope that our clients and their loved ones never experience a traumatic and life-altering event such as a pedestrian getting struck by a vehicle, we are proud to obtain justice and compensation in a severe and complex case such as this.
