A Lyft accident can leave a passenger, driver, pedestrian, or cyclist facing medical treatment, lost income, and questions about who may be responsible for the resulting losses.

This page explains how Lyft accident claims work in Rhode Island, who may be liable, how rideshare insurance coverage changes based on driver status, and what deadlines may affect a claim.

Our East Providence Lyft Accident Attorneys Get Results
Marasco & Nesselbush has secured substantial recoveries for Rhode Islanders injured in serious motor vehicle collisions, including passengers, pedestrians, and families who lost a loved one.
Each recovery reflects the work of establishing fault, documenting long-term losses, and pursuing fair compensation through settlement and trial.
Although the matters below were not necessarily rideshare cases, every case depends on its own facts, evidence, injuries, insurance coverage, and applicable law, and past results do not guarantee or predict the outcome of another claim.
Examples of recoveries obtained by our attorneys include:

- $4.5 Million Recovered: Secured for a client who sustained a traumatic brain injury in a motor vehicle collision.

How Lyft Insurance Coverage Works in Rhode Island
Insurance coverage after a Lyft accident in Rhode Island can depend in part on what the driver was doing through the app when the crash occurred.
Rhode Island’s Transportation Network Company laws establish different insurance requirements for drivers who are logged in and waiting for a request and drivers who have accepted a prearranged ride.
Under R.I. Gen. Laws § 39-14.2-14, the required coverage may be maintained by the Lyft driver, the transportation network company, or a combination of both.
Because complex insurance policies may overlap, accident reports, app-status information, trip records, and the applicable policy documents can all be relevant when determining what coverage may apply.
Driver Offline
When a Lyft driver is logged out of the app, Rhode Island’s special rideshare insurance requirements generally do not apply.
The driver’s personal auto insurance may provide coverage during this period, depending on the policy terms and the circumstances of the collision.
Other coverage may also be relevant.
For example, if another motorist caused the accident, that driver’s liability policy may apply, and uninsured or underinsured motorist coverage may become important in some cases.
The fact that a Lyft driver is offline does not mean the driver’s personal policy is limited to Rhode Island’s minimum insurance requirements.
The actual policy limits and available coverage must be reviewed.
Driver Logged In and Waiting for a Request
When a Lyft driver is logged into the app and available to receive ride requests but has not yet accepted a ride, Rhode Island requires primary automobile liability insurance of at least:
- $50,000 for death or bodily injury per person
- $100,000 for death or bodily injury per incident
- $25,000 for property damage
Uninsured and underinsured motorist coverage must also be provided to the extent required by Rhode Island law.
These requirements may be satisfied by insurance maintained by the driver, Lyft, or a combination of both.
If driver-maintained insurance used to satisfy these requirements has lapsed or does not provide the required coverage, insurance maintained by the rideshare company must provide the statutory coverage beginning with the first dollar of the claim.
Rhode Island law also provides that TNC-maintained coverage cannot be conditioned on the driver’s personal auto insurer first denying the claim.
Driver En Route to a Passenger or Completing a Ride
A prearranged Lyft ride begins when the driver accepts a passenger’s request through the app and continues until the last requesting passenger leaves the vehicle.
During this period, Rhode Island requires at least $1.5 million in primary automobile liability insurance covering death, bodily injury, and property damage.
This requirement applies while the driver is traveling to pick up the passenger as well as while the passenger is being transported.
Lyft’s national insurance materials generally describe at least $1 million in third-party liability coverage during pickup and rides, but Rhode Island law imposes the higher $1.5 million minimum for prearranged rides in the state.
The $1.5 million figure is an insurance limit, not an amount automatically paid to an injured person.
The amount that may be recovered depends on liability, the injuries and damages supported by the evidence, the applicable insurance policy limits, and the number and nature of any competing claims.
When the At-Fault Driver Carries Too Little Insurance
A Lyft accident may also involve a driver other than the rideshare driver.
If another motorist causes the crash and has no insurance or insufficient insurance, uninsured or underinsured motorist coverage may become relevant.
Rhode Island requires TNC insurance to include uninsured and underinsured motorist coverage to the extent required by R.I. Gen. Laws § 27-7-2.1.
An injured passenger may also have coverage through a personal or household auto policy depending on who qualifies as an insured and the terms of that policy.
Underinsured motorist coverage does not automatically pay whatever amount remains after the at-fault driver’s policy is exhausted.
Recovery depends on the applicable UIM limits, the damages legally recoverable, the policy language, and other coverage that may apply.
Personal Auto Insurance and Multiple Insurers
Rhode Island law permits personal auto insurers to exclude coverage while a driver is logged into a rideshare platform or providing a prearranged ride.
Those exclusions may apply to liability, uninsured and underinsured motorist coverage, medical payments coverage, collision coverage, comprehensive coverage, and other protections.
The law does not require every personal insurer to use such an exclusion, and additional coverage may be available through a rideshare endorsement or other policy terms.
As a result, a Lyft accident involving significant injuries, medical bills, or property damage may require communication with multiple insurers.
Reviewing the driver’s app status, accident reports, Lyft records, and each potentially applicable policy can help identify the coverage available for a particular claim.

Common Causes of Lyft Accidents in East Providence
Lyft accidents can happen for many of the same reasons as other car accidents in East Providence.
Distracted driving, speeding, unsafe lane changes, failure to yield, fatigue, impairment, and other forms of negligent driving can cause a collision regardless of whether one of the vehicles is being used for rideshare services.
Rideshare driving can introduce additional circumstances that may contribute to a crash.
Lyft drivers use app-based navigation, receive ride requests, travel to unfamiliar pickup locations, and frequently stop to pick up or drop off passengers.
These factors do not automatically make rideshare driving unsafe, but they may become relevant when investigating how a particular accident occurred.
East Providence drivers also travel through heavily used corridors such as I-195, where temporary traffic patterns associated with the Washington Bridge project remain in place.
Congestion, construction activity, merging traffic, and changing roadway conditions require the same attention and reasonable care expected of any driver.
Common causes and contributing factors in Lyft accidents may include:
- Distracted driving: Looking at a phone, navigation instructions, a ride request, or another distraction can take a driver’s attention away from surrounding traffic.
- Speeding: Driving above the speed limit or too fast for traffic, weather, or construction conditions can reduce the time available to avoid a collision.
- Unsafe lane changes and merging: Failing to check surrounding traffic, signal, or leave enough space when changing lanes can cause sideswipe and other collisions.
- Failure to yield: Drivers who disregard right-of-way rules at intersections, crosswalks, or while entering traffic can cause serious accidents involving other motorists, pedestrians, or cyclists.
- Driver fatigue: Long periods behind the wheel can affect attention and reaction time. Lyft also requires drivers in most regions to take a six-hour uninterrupted break after spending 12 hours in driver mode.
- Unsafe pickups and drop-offs: Sudden stops, double parking, or pulling into traffic while picking up or dropping off a passenger can create hazards for surrounding road users.
- Impaired driving: Alcohol or drug impairment by a Lyft driver or another motorist may contribute to a collision.
- Negligence by another driver: The Lyft driver does not have to be at fault. Another motorist may cause the crash through speeding, distraction, impairment, or another unsafe driving behavior.
- Vehicle or roadway problems: A defective vehicle component, negligent maintenance, or a dangerous roadway condition may also contribute to some accidents.
Determining what caused a Lyft accident requires examining the circumstances of the individual crash.
Police reports, photographs, witness accounts, available video, vehicle information, and Lyft trip records may help identify the conduct and conditions that contributed to the collision.
Common Lyft Accident Injuries
A Lyft accident can injure passengers, rideshare drivers, occupants of other vehicles, pedestrians, and cyclists.
The type and severity of an injury can depend on the speed and direction of the collision, the point of impact, and other circumstances surrounding the crash.
Some injuries are immediately apparent, while symptoms of others may develop or become more noticeable after the accident.
Seeking appropriate medical attention promptly can help identify injuries and document the treatment provided after the collision.
Common injuries associated with Lyft accidents include:
- Traumatic brain injuries: Head trauma can result from a direct impact or from violent movement of the head during a collision. A traumatic brain injury may cause headaches, dizziness, memory problems, difficulty concentrating, or other cognitive and neurological symptoms.
- Spinal cord injuries: Damage to the spinal cord can cause weakness, loss of sensation, reduced mobility, or permanent disability. In severe cases, spinal cord injuries can result in lifelong paralysis and substantial long-term care needs.
- Whiplash and neck injuries: Sudden movement of the head and neck can strain muscles, ligaments, and other structures, causing pain, stiffness, headaches, or limited movement.
- Broken bones: Fractures involving the arms, legs, ribs, pelvis, wrists, or other areas can occur during a serious collision. Depending on the fracture, treatment may include surgery, immobilization, physical therapy, and rehabilitation.
- Back injuries: Herniated discs, vertebral injuries, muscle strains, and nerve damage can cause pain, weakness, numbness, or limitations on movement.
- Internal injuries: Blunt-force trauma can damage internal organs or cause internal bleeding that may require emergency medical treatment.
- Soft tissue injuries: Sprains, strains, ligament injuries, and other soft tissue damage can cause pain, swelling, and reduced mobility.
- Emotional distress: Anxiety, sleep problems, fear of riding or driving, and other psychological effects may also follow a serious accident.
Medical records, diagnostic testing, treatment history, and expert opinions can help document the nature and extent of an injury.
These records may also show whether the accident caused lasting limitations, future medical needs, or other losses that should be considered as part of a Lyft accident claim.
Determining Liability in a Rhode Island Lyft Accident Case
Liability after a Lyft accident depends on whose conduct caused or contributed to the collision.
Some crashes involve one negligent driver, while others involve multiple parties whose actions played a role in the accident.
Rhode Island’s rideshare laws can also affect claims involving Lyft drivers.
Under R.I. Gen. Laws § 39-14.2-16, rideshare drivers may be classified as independent contractors when the statutory requirements are satisfied.
That classification can affect whether Lyft may be held responsible for the conduct of a driver, although it does not necessarily prevent a claim based on Lyft’s own actions.
Parties that may be responsible for a Lyft accident include:
- The Lyft driver: An Uber or Lyft driver may be liable when speeding, distracted driving, unsafe lane changes, failure to yield, fatigue, or another negligent act causes the collision.
- Another motorist: A driver of another vehicle may be responsible when that person’s negligence causes or contributes to the crash. The driver’s auto insurance policy may provide coverage for resulting injuries and losses.
- Multiple drivers: A Lyft driver and another motorist may both share responsibility when each contributed to the rideshare collision. Rhode Island’s comparative negligence rules allow fault to be divided among the responsible parties.
- Lyft: A direct claim against Lyft may be possible when the company’s own conduct contributed to the harm, such as a failure involving driver-screening or other responsibilities imposed by Rhode Island law. Whether such a claim exists depends on the facts and evidence.
- A vehicle manufacturer or repair provider: A defective vehicle component or negligent repair may create a separate claim if a mechanical problem contributed to the accident.
- Other potentially responsible parties: Depending on the circumstances, a vehicle owner, employer of another driver, contractor, or government entity may also become part of the liability analysis.
Liability and insurance coverage are related but separate questions.
Identifying the people and companies that may be legally responsible helps determine which insurance providers and policies should be reviewed as part of the claim.
When Lyft accidents involve multiple parties, attorneys may examine police reports, witness statements, photographs, video, vehicle information, trip records, and other evidence to determine how responsibility should be allocated.
Potential Compensation in a Lyft Accident Case
Damages in a Lyft accident case are intended to compensate an injured person for the financial and personal losses caused by the crash.
The amount that may be recovered depends on factors such as the severity and permanence of the injuries, past and future medical costs, lost income, the effect of the injuries on daily life, liability, and the insurance coverage available.
Compensation may include:
- Medical expenses: Emergency treatment, hospital care, diagnostic testing, surgery, medication, physical therapy, rehabilitation, and other medical costs related to the accident.
- Future medical costs: A serious or permanent injury may require additional treatment, rehabilitation, assistive equipment, home care, or other medical services in the future.
- Lost wages: An injured person may seek compensation for income lost while unable to work because of the accident and recovery.
- Reduced earning capacity: Lasting injuries that limit a person’s ability to work or earn income may support a claim for future financial losses.
- Pain and suffering: Compensation may account for physical pain, discomfort, limitations, and other effects of the injuries.
- Emotional distress: Anxiety, sleep problems, fear, depression, and other psychological effects may be considered when supported by the circumstances and evidence.
- Permanent disability or disfigurement: Serious injuries that result in lasting physical limitations, scarring, or disfigurement may support additional damages.
- Loss of enjoyment of life: Compensation may account for the effect an injury has on hobbies, relationships, independence, and other activities the person previously enjoyed.
- Personal property damage: A claim may also include damage to a phone, glasses, clothing, or other personal property damaged in the collision.
If a Lyft accident results in death, a wrongful death action may be available under Rhode Island law.
Under R.I. Gen. Laws § 10-7-2, these actions are generally brought by the executor or administrator of the deceased person’s estate, while separate statutory provisions address certain losses involving society, companionship, or consortium.
When liability is established under the wrongful death statutes, Rhode Island provides a minimum recovery of $350,000.
Punitive damages are different from compensatory damages and are available only in limited circumstances.
Rhode Island requires conduct substantially more serious than ordinary negligence, such as willfulness, recklessness, wickedness amounting to criminality, malice, or bad faith.
Whether the facts of a particular Lyft accident could support punitive damages depends on the conduct involved.
Medical records, bills, employment documentation, expert opinions, and other evidence can help establish the full extent of the losses caused by the accident.
Marasco & Nesselbush can evaluate past and future damages and pursue the compensation supported by the evidence and Rhode Island law.
Rhode Island Laws That Can Affect a Lyft Accident Claim
Several Rhode Island laws can affect liability, damages, evidence, and filing deadlines in a Lyft accident lawsuit.
These rules apply to personal injury claims generally but can become especially important when a rideshare accident involves disputed fault, multiple insurance policies, or serious injuries.
Important Rhode Island laws include:
- Pure comparative negligence: Under R.I. Gen. Laws § 9-20-4, an injured person may still recover compensation even when partly responsible for a crash. The amount recovered is reduced according to the percentage of fault assigned to that person. For example, someone found 20% responsible would generally recover 80% of the damages established.
- Seat belt evidence: R.I. Gen. Laws § 31-22-22 provides that failure to wear a required seat belt is not negligence and is not admissible as evidence in the trial of a civil action. An injured Lyft passenger therefore is not automatically prevented from recovering compensation because the person was not wearing a seat belt.
- Prejudgment interest: Under R.I. Gen. Laws § 9-21-10, prejudgment interest generally accrues at 12% per year on qualifying pecuniary damages when a judgment is entered in a civil action. This can become relevant when evaluating the potential value of a judgment and a fair settlement.
- Statute of limitations: Rhode Island generally allows three years to file a personal injury lawsuit under R.I. Gen. Laws § 9-1-14(b). Different rules may apply in cases involving wrongful death, minors, government entities, or other special circumstances.
These laws are only part of the legal framework that may apply to a Lyft accident claim.
Liability, insurance coverage, available evidence, and the parties involved can all affect how Rhode Island law applies to an individual case.
Lyft Trip Records and Evidence Preservation
Lyft trip and driver records can provide important evidence after an accident, particularly when the driver’s app status or activities before the crash are disputed.
Under R.I. Gen. Laws § 39-14.2-20, transportation network companies must maintain individual trip records showing information such as the date and time of the ride, pickup and drop-off locations, distance traveled, trip duration, and fare charged.
Lyft must also maintain operator records that include log-on and log-off times, the number of trips completed, miles driven, fares collected, and certain passenger complaint information.
Rhode Island requires these records to be retained for a minimum of two years from December 31 of the calendar year in which the rideshare services were provided.
That retention requirement is separate from the statute of limitations for filing a personal injury lawsuit.
Other evidence may have much shorter retention periods.
Video from nearby businesses or private cameras, for example, may become unavailable over time, and vehicles may be repaired or altered after a collision.
A Lyft accident lawyer can request relevant trip and operator records and take appropriate steps to preserve other evidence that may be important to the claim.
Acting early can make it easier to obtain information about the driver’s app status, the circumstances of the trip, and how the accident occurred.
What to Do After a Lyft Crash in East Providence
The steps taken after a Lyft accident can protect an injured person’s health and preserve evidence that may later be important to the claim.
Rideshare cases can involve multiple parties and insurance policies, and the coverage available may depend in part on the Lyft driver’s app status when the collision occurred.
After a Lyft crash in East Providence, consider taking the following steps:
- Call 911 if anyone is injured: Report the accident and request emergency medical assistance when necessary. A responding officer can document the people and vehicles involved, roadway conditions, statements, and other information observed at the accident scene.
- Seek medical attention: Get appropriate medical care promptly, even if some injuries initially appear minor. If symptoms develop or worsen after leaving the scene, seek medical advice. Medical records can document the injuries and treatment and may later support claims involving medical expenses, future medical costs, and other damages.
- Document the accident scene: If it is safe to do so, photograph or record the vehicles, damage, road conditions, traffic signals, visible injuries, and surrounding area. Preserve the original images rather than relying only on copies posted or sent elsewhere.
- Gather driver and witness information: Obtain the Lyft driver’s name, vehicle information, driver’s license and available insurance information, along with similar information from other motorists involved. Save contact information for anyone who witnessed the collision.
- Save your Lyft trip information: Keep the ride receipt and save screenshots or exports showing the driver’s name, vehicle, route, pickup and destination, and trip times. This information may help identify the ride involved and evaluate the driver’s status when the crash occurred.
- Report the accident to Lyft: Lyft provides a process for riders and drivers to report accidents and collisions. Keep a copy or screenshot of the information submitted and any correspondence you receive afterward.
- Notify applicable insurance companies: Depending on the circumstances, notice may need to be provided to your own insurer, another driver’s insurer, or a rideshare insurance carrier. Because coverage can vary based on the driver’s app status and the policies involved, an experienced attorney can help determine which insurance policy or policies may apply.
- Preserve medical and financial records: Keep medical records and bills, prescription receipts, employment records, wage information, transportation expenses, and correspondence related to the accident. These documents can become important when documenting the financial effects of the injuries.
- Be cautious with recorded statements and releases: Insurance adjusters may request a recorded statement, medical authorization, or signed release while investigating the accident. Consider speaking with an experienced Lyft accident lawyer before providing a detailed recorded statement or signing documents that could affect your legal rights. If your own insurer is requesting information, review and comply with any applicable duties under your policy.
- Consider speaking with a Lyft accident lawyer: Legal representation can help identify potentially responsible parties, evaluate the applicable insurance coverage, request Lyft records, preserve evidence, and explain the legal process. An attorney can also handle communications with insurers while the claim is investigated.
Preserving evidence early can be useful in a Lyft accident case, particularly when app data, trip information, witness accounts, or video may help establish what happened.
Marasco & Nesselbush can review the accident, determine which insurance policies may apply, and explain the options available under Rhode Island law.
